TERMS OF SERVICE OF THE ONLINE STORE

Online store "moodsyou.com" operating at https://moodsyou.com/ is a service operated by a company under the name of Hanna Kitayeuskaya with registration in Warsaw, Łowicka, nr 25, lok. A7, 02-617, Poland, NIP 5213967007 REGON 521942569 (hereinafter referred to as "online store")

Definitions

ADDRESSEE - the entity designated by the Customer as appropriate to receive the shipment.

DELIVERY - means the actual act of delivering to the Buyer by the Seller, including through the Supplier, the Goods specified in the order, or the Buyer's receipt of the Goods specified in the order of the Business Premises.

SUPPLIER - an entity that, in agreement with the Seller, performs the Delivery of Goods to the Buyer, in particular, a courier company, public operator, parcel equipment operator.

WARRANTY - a voluntary commitment by the manufacturer of a given product, given on the basis of a warranty statement, defining its obligations and the rights of the Buyer (Consumer) or Entrepreneur on the rights of the consumer, in case the goods do not have the characteristics specified in this statement.

CONSUMER - a natural person who, in accordance with Article 22(1) of the Civil Code, makes a legal transaction with an entrepreneur that is not directly related to his/her business or professional activity.

ORDER CART - an IT program provided by the Seller on the moodsyou.com website, which allows you to place an Order.

BUYER - a consumer, entrepreneur or entrepreneur on the rights of a consumer who enters into a contract of sale in the Online Store moodsyou.com; the Buyer is also a Service Recipient.

ENTERPRISE LOCATION (STATION STORE) - the premises of the Entrepreneur, where the Seller - Hanna Kitayeuskaya - conducts its business activities on a permanent basis: Warsaw, Łowicka, nr 25, lok. A7, 02-617, Poland.

ENTREPRENEUR - a natural person, a legal person, an organizational unit without a legal entity, which, in accordance with Article 43(1) of the Civil Code, conducts business or professional activities on its own behalf in connection with legal actions, and performing a legal action directly related to its business or professional activities.

ENTERPRISE UNDER CONSUMER RIGHTS - a natural person who enters into a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, arising in particular from the subject of his/her business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity.

COMPLAINT - a mode of claiming responsibility by a consumer, a businessman on the rights of a consumer, or a businessman in connection with the identified non-conformity of goods with the Sales Agreement, under the provisions of the Law on Consumer Rights and the Civil Code (warranty).

SELLER - an entrepreneur operating an online store covered by these terms and conditions, i.e. a company under the name of Hanna Kitayeuskaya in Warsaw, Łowicka, nr 25, lok. A7, 02-617, Poland; the Seller is also the Service Provider.

GOODS - all products offered for sale in the online store moodsyou.com

SALE AGREEMENT - an agreement by which the Seller - entrepreneur undertakes to transfer the ownership of an item (Goods) to the Buyer and deliver the item to him, and the Buyer undertakes to receive the item (Goods) and pay the price to the seller, concluded without the simultaneous physical presence of the parties to the agreement, by means of one or more means of distance communication up to and including the conclusion of the agreement.

SERVICE PROVIDER - Entrepreneur running an online store covered by these Terms and Conditions, i.e. Hanna Kitayeuskaya Warsaw Łowicka, nr 25, lok. A7, 02-617, Poland. The Service Provider may be a Seller at the same time.

USER - a natural person, a legal person or an organizational unit without legal personality, who uses the service provided by the Service Provider electronically; the Customer may be a Buyer at the same time.

ORDER - a declaration of will of the Buyer, the purpose of which is to conclude a contract of sale of Goods, by indicating the Goods, type and number of them.

General provisions and use of the online store

  • The Regulations set out the rules for the use of the online store, through the sale of goods at a distance, as well as the rules for the use of the online store by customers, placing orders for Goods, payment of the sales price of products, delivery of products, the rights of the Buyer to withdraw from the contract and the rules for filing and processing complaints, as well as how to return products.
  • To browse the store's assortment and place orders for the offered products, a computer or other device (smartphone, tablet) with access to the network is required Internet and a web browser, e.g. Google Chrome, Mozilla Firefox, and an active electronic mail (e-mail) account.
  • Browsing the store's assortment does not require registration.
  • To register an account with the online store, the customer fills out an online registration form, providing his/her name, e-mail address, a password of his/her choice, and is required to accept the store's regulations and Privacy Policy. Registration in the store and use of the store's functionalities are free of charge. The Service Provider uses cookies to collect information related to the Client's use of the online store in order to maintain the logged-in Client's session and to keep statistics on the viewing of sub-pages of the online store. The Service Recipient may at any time remove the placed cookies or block the placement of cookies using the options available in his/her web browser.
  • A customer who has registered a customer account on the Service Provider's website shall terminate the contract for the provision of electronic services by requesting the deletion of the account. The Service Provider shall remove the registered Customer Account and/or email address from the list of subscribers without undue delay. If you want to delete your account on the moodsyou.com platform, please contact us by email via contact@moodsyou.com. 
  • The Store does not conduct wholesale sales of Goods, as well as sales of Goods for resale.
  • The Seller may cancel an order placed by a Customer who is not a Consumer (i.e. withdraw from the Contract of Sale within the meaning of Article 395 of the Civil Code) from the moment of conclusion of the Contract of Sale until the expiration of 14 days from the date of Delivery of the Goods. Withdrawal from the Sales Agreement in this case may take place without giving any reason, in particular when the order indicates the purchase of the Goods for further resale. The withdrawal does not give rise to any claims on the part of the Customer who is not a Consumer against the Seller.
  • The online store does not use individual price adjustment.

Terms of sale

  • Information about products available in the store's assortment is an invitation to conclude a sales contract within the meaning of Article 71 of the Civil Code.
  • The subject of the sale are new products, free of defects, presented by the store at the time of placing an order by the buyer.
  • All prices of goods in the online store are given in Polish zloty (PLN) and are gross prices, i.e. they include taxes.
  • The prices of goods on the website of the online store do not include delivery costs, the amount of which depends on the chosen method of delivery of the product to the Buyer, as well as on the value and characteristics of the ordered product (including its weight and size) and are indicated when the Customer chooses the method of delivery of the goods. The total cost of the order including the price of the products together with the cost of delivery is indicated in the shopping cart before the customer places the order.
  • In order to conclude a sales contract, you must:

- place an order on the website of the online store through the order cart - the "Add to cart" button;

- confirm that you are aware that your order entails payment by activating the "Complete order" button in the last step of the order cart;

- enter the details of the recipient of the order and the address to which the Goods are to be delivered, as well as the telephone number at which the Seller may contact the Buyer on matters related to the order;

- confirm the order with the button: "Complete order";

- pay the order in one of the available payment methods within 3 days.

Delivery

Please allow 2-3 days to process your order. Expect an email within the period to let you know your order is on the way.

Shipping charges for your order depend on the selected delivery method and will be calculated and displayed at checkout.

Shipment Tracking

You can track your order via the Shipment Notification E-mail(s), Order Confirmation Page or the Account section on moodsyou.com.

Please note that you may receive more than one Shipment Notification E-mail if item(s) from your order are shipping separately.

If the tracking information on the shipping carrier page for your order has not shown activity/movement for more than 5 business days, please contact Customer Service at contact@moodsyou.com.

Changing Shipping Address

Shipping addresses cannot be changed. We will only ship to the shipping address entered when the order was originally placed.

Refund and return policy

We have a 14-day return policy, which means you have 14 days after receiving your item to request a return.

To be eligible for a return, your item must be in the same condition that you received it, unworn or unused, clean, “fragrance-free” (e.g., cream, perfume), unwashed, with tags, and in its original packaging.

To start a return, you can contact us at contact@moodsyou.com or through the user personal account at https://account.moodsyou.com/orders. Please note that returns will need to be sent to the following address: Łowicka 25, A7, 02-617 Warsaw, Poland, in-Post parcel post: WAW100M.

Afterwards, you will receive instructions on how to return goods.

Damages and issues
Please inspect your order upon reception and contact us immediately if the item is defective, damaged or if you receive the wrong item, so that we can evaluate the issue and make it right.

Exceptions / non-returnable items
Certain types of items cannot be returned, like perishable goods (such as food, flowers, or plants), custom products (such as special orders or personalized items), and personal care goods (such as beauty products). The following items are non-returnable: clothing bearing signs of use, products after laundry. We also do not accept returns for hazardous materials, flammable liquids, or gases. Please get in touch if you have questions or concerns about your specific item.

Unfortunately, we cannot accept returns on sale items or gift cards.

Exchanges
The fastest way to ensure you get what you want is to return the item you have, and once the return is accepted, make a separate purchase for the new item.

European Union 14 day cooling off period
Notwithstanding the above, if the merchandise is being shipped into the European Union, you have the right to cancel or return your order within 14 days, for any reason and without a justification. As above, your item must be in the same condition that you received it, unworn or unused, with tags, and in its original packaging. You’ll also need the receipt or proof of purchase.

Refunds
We will notify you once we’ve received and inspected your return, and let you know if the refund was approved or not. If approved, you’ll be automatically refunded on your original payment method within 10 business days. Please remember it can take some time for your bank or credit card company to process and post the refund too.

Withdrawal from the contract

A consumer who has concluded a distance contract may withdraw from it without giving any reason and without incurring any costs other than those provided for by law, within 14 days (hereinafter also "Withdrawal from the contract");

The consumer may withdraw from the contract by submitting a declaration of withdrawal to the Seller. The declaration may be made on a form, a specimen of which is attached to the Terms and Conditions.

Immediately, but no later than within 14 days from the date on which the Consumer has withdrawn from the contract, he/she is obliged to return the Goods to the Seller or hand them over to a person authorised by the Seller. It is sufficient to send the Goods back before the deadline. This provision shall not apply if the Seller has offered to collect the Goods himself.

The consumer shall be liable for any diminution in the value of the Goods resulting from use beyond that which is necessary to ascertain the nature, characteristics and functioning of the Goods.

In the event of withdrawal, the contract shall be deemed not to have been concluded. If the Consumer has made a declaration of withdrawal before the Seller has accepted his offer, the offer shall cease to be binding.

In the event of withdrawal from the contract and return of the goods, the costs of returning the item to the seller are borne by the buyer.

Claims

The claims may be lodged by letter or e-mail to the postal or electronic address of the Seller. It can be submitted using the form, the specimen of which is attached to the Terms and Conditions, but it is not obligatory.

In the body of the claim submitted, it is recommended to include:

  • the consumer's contact details for responding to the complaint and for correspondence relating to the complaint,
  • the number of the Consumer's bank account to be used for reimbursement of the money, should the case arise, a description of the problem and the identity of the consumer.

In the event that the warranty complaint relates to Goods, in order for the complaint to be considered by the Seller, the Consumer is obliged to deliver or send the Goods complained about to the Seller's address, at the Seller's expense. The Seller shall consider complaints within 14 days from the date of notification.

The Seller shall inform the Consumer of the manner in which the claim received will be resolved by e-mail or by ordinary letter, depending on the Consumer's wish or the method used by the Consumer to lodge the complaint.

If the warranty claim relates to Goods that are subject to shipment to the Consumer after the complaint has been recognised, the Seller shall deliver or send the Goods to the Consumer's address.

Data protection

Pursuant to Article 13 of Regulation (EU) 2016/678 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free flow of such data and repealing Directive 95/46/ EC (Official Journal of the EU.L 2016 No. 119), (hereinafter referred to as "RODO"), the Seller informs that: The Administrator of the Personal Data is: Hanna Kitayeuskaya with registration in Warsaw, Łowicka, nr 25, lok. A7, 02-617, Poland, NIP 5213967007, REGON 521942569.

Data protection issues are regulated in the Privacy Policy.
